How Do I Buy a Home in New York? A Step by Step 2026 Guide

Buying in New York has its own order and its own costs. Here is the real map, start to finish, the way I walk buyers through it every week, so nothing surprises you at the closing table.

Step 1: Get a real pre approval, not a pre qualification

A pre qualification is an unverified guess. A pre approval means the lender pulled your credit, verified your income and assets, and put a real number in writing. In Staten Island and Brooklyn, a strong offer starts with that letter, and your debt to income ratio, not just your down payment, is what actually sets your budget.

Step 2 and 3: Pick a local agent, then tour with a plan

New York real estate is hyper local, so work with someone who knows which blocks flood and what a fair price looks like this month. How your agent gets paid is negotiable and often covered through the seller side, so settle that up front. Then tour with clear non negotiables and always ask about the basement, the flood zone, and the real property taxes.

Step 4 and 5: The offer, and why nothing is binding yet

New York is an attorney state, so an accepted offer is not a binding deal. Nothing binds until both attorneys sign contracts, so line up your real estate attorney early. And here the inspection generally happens before contracts are signed, which is your window to renegotiate or walk with full leverage before you commit.

Step 6: Appraisal and full underwriting

Once contracts are signed you move into the appraisal and full underwriting. Do not make big financial moves here: no new car, no new credit cards, no large unexplained deposits, and do not switch jobs if you can avoid it, because any one of those can sink your loan.

The New York costs that catch buyers off guard

Budget 2% to 5% of the price in closing costs. The big New York specific ones are the mortgage recording tax on your loan, which runs a little over 2% in the city, and the mansion tax, which starts at 1% of the entire price the moment you hit $1,000,000. Add your attorney, title insurance, and prepaids.

Step 7 and 8: Final walk through and closing

Right before closing you do a real final walk through to confirm the home is in the agreed condition. Then closing is an in person, attorney driven event where the deed transfers, funds are wired, and you get the keys. Your attorney has protected you the whole way, which is exactly why New York does it this way.
